On Friday the 25th of November 2016, the Australian Border Force (‘ABF’) notified the Australian Federal Police (‘AFP’) that a DHL consignment containing six packages had been intercepted which was suspected of containing the dangerous drug methamphetamine.
Upon forensic examination of the consignment each package was found to contain a crystalline substance which after later analysis tested positive for methamphetamine. The total weight of methamphetamine found within the consignment was 20 kilograms, which has a street value of 20.6 million dollars.
The six packages were later delivered to the address listed on the consignment and on the 29th November 2016 the AFP observed the vehicle of our client park at the listed address. At which time our client and the co-accused in the matter exited the vehicle and collected the six packages and loaded them into the vehicle. Later that day our client was arrested by the AFP and charged with one (1) count of attempt to possess commercial quantity of unlawfully imported border controlled drug (Methamphetamine).
Alan Phillips of our office took carriage of the matter on the 1st December 2016 and reviewed the large brief of evidence disclosed by the Office of the Commonwealth Director of Public Prosecutions (‘CDPP’). There was no evidence to suggest that our client had any knowledge or belief that the dangerous drug methamphetamine was contained within the consignment he collected. Our client was simply helping a friend to move some boxes.
After negotiations with the CDPP, on Friday the 23rd of June 2017 at the Brisbane Magistrates Court, the CDPP advised the court that the prosecution would offer no evidence in relation to the charge against our client and the client was discharged.
Our client was subsequently released from prison that day; an excellent result for our client.
