Prison stabbing case against client dropped by Brisbane Director of Public Prosecutions

In 2015, a 28 year old man incarcerated in the Woodford Correctional Centre was charged with unlawful wounding of another prisoner after an alleged stabbing occurred in one of the prison’s bathrooms. This charge carries a maximum penalty of seven (7) years imprisonment.

Alan Phillips of our office along with Damian Walsh of Counsel conducted a comprehensive review of the brief of evidence, including CCTV footage of the day in question. The brief of evidence was cross referenced with the self-defence provisions contained within Chapter 26 of the Queensland Criminal Code.

This case was negotiated by Alan Phillips and Damian Walsh with the Crown Prosecutor on 28 January 2016. Mr Walsh submitted that the Crown would be unable to prove beyond reasonable doubt that the accused did not act in self-defence. As a result of this negotiation, the Crown accepted that submission and agreed to discontinue the charge.
